WAGNER'S WEBLOG:
SCO's Linux lawsuit has more surprises than an amnesiacs' family
reunion. Novell drove the latest development, releasing a
statement on Wednesday that effectively says that SCO has no
standing to file any claims that other people infringed on SCO's
intellectual property because (says Novell) SCO doesn't own the
copyright and patents to Unix. 

SCO responded that its claims never rested on copyrights and
patents, but rather on contracts, and that even if the claim DID
rest on copyrights and patents, SCO does too own them. 

SCO in March filed a $1 billion lawsuit against IBM, saying that
IBM illegally included Unix code that belonged to SCO in Linux.
The company followed up with a letter this month warning big
companies that they might be liable for Unix intellectual
property infringements if they used Linux. 

Also on Wednesday SCO said it achieved its first-ever quarterly
profit in the second fiscal quarter ending April 30. The company
said it derived $13.1 million revenue from the sale of operating
system platforms, while the remainder came from licensing Unix
source code.
